Terms of Service

These Terms of Service ("Terms") are an agreement between you and Selby Studio LLC ("Selby Studio," "we," "us," or "our"), a California limited liability company based in Santa Monica, California. They govern your use of our websites, products, and services.

1. Using our services

You must be at least 18 years old (or the age of majority where you live) to make a purchase. By using our services you agree to these Terms and represent that the information you provide — at checkout, in an account, or in a listing — is accurate and yours to provide.

2. Purchases, subscriptions & billing

• Payments are processed by Stripe. Prices are shown at checkout and may change prospectively; applicable taxes are calculated and collected at purchase.
• Subscriptions (for example, Encore General Admission or VIP) renew automatically each billing period until cancelled. You can cancel at any time via the billing portal link in your receipt or by emailing us; cancellation takes effect at the end of the current period.
• Promotional pricing applies for the stated promotional period and reverts to the standard price afterward.
• Refunds. If something we sold you doesn't work as described, contact us within 14 days and we'll make it right — a fix, a replacement, or a refund. Made-to-order physical goods (such as personalized Everbound books) can't be refunded after production begins except where required by law, including your statutory rights under UK/EU consumer law.

3. Digital products & licenses

Software, plugins, kits, and other digital content we sell are licensed, not sold. Your subscription grants a personal, non-exclusive, non-transferable license to use the product while your subscription is active. You may not resell, redistribute, or share access with others outside your household or, for team purchases, your organization.

4. AI-assisted products

Some products (such as Encore) operate within your own third-party AI subscription (for example, Claude or ChatGPT) and are subject to those platforms' terms. Outputs generated with AI assistance are provided as-is, for your review: they may contain errors, and nothing they produce is professional, legal, financial, or investment advice. You are responsible for reviewing anything before you rely on it, publish it, or act on it. We do not guarantee any particular output, outcome, or availability of third-party platforms we don't control.

5. Marketplace listings (PupMate)

PupMate connects rescues and rehomers with prospective adopters. Listers are responsible for the accuracy and legality of their listings, including compliance with applicable animal-welfare law. We screen and verify in good faith but are not a party to adoptions and do not guarantee any animal, lister, or adopter. Report concerns to us and we will investigate.

6. Acceptable use

You agree not to misuse our services — including attempting to breach security, scraping at scale, infringing others' rights, submitting false information, using the services for anything unlawful, or interfering with other users. We may suspend or terminate access that violates these Terms, with a refund of any unused prepaid period where the violation wasn't willful.

7. Intellectual property

Our websites, products, brands, logos, and content are owned by Selby Studio LLC or its licensors. You keep ownership of the content you submit to us, and grant us the license needed to operate the service (for example, displaying a listing or printing a personalized book you ordered).

8. Disclaimers

Except as expressly stated, our services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the services will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, Selby Studio LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data. Our total liability for any claim relating to a product is limited to the amount you paid us for that product in the twelve months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law, or your statutory consumer rights.

10. Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Los Angeles County, California — except that if you are a consumer in the UK or EU, you retain any mandatory protections and venue rights of your home country. Before filing anything, email us — we'd rather just fix it.

11. Changes

We may update these Terms as our products evolve. Material changes will be posted here with a new effective date. Continued use after a change means you accept the updated Terms.
